How can we fight Target now that they cancelled our orders for the Britax car seat on Sale for $42.99?
2009-05-12 at 08:13 pm adminLike many of you moms, yesterday I bought the Britax Granite Marathon Car Seat that was on Sale for $42.99 on the Target website and now I get an email saying my order has been cancelled and if I want to to reorder I have to pay the original price of $279.99.
How can they do that?
Shouldn’t they have to honor the price that was listed, the price I was charged?
What can we do to fight Target so we get the car seat for the price they advertised?
Yes I have paid for it, my credit card was charged yesterday.
The foster mom I provide respite for also got an email saying her order had been cancelled.
The email says it was an due to unexpected error, the item I ordered was incorrectly priced at the time I of my order.
I just received a call from the foster mom I provide respite for, Target contacted her and told her that they had over 20,000 hits on that car seat and could not take that huge of a loss on it, so all the orders were cancelled.

edit: someone else just posted a question saying they canceled it because people were buying lots of them and turning around and selling them
I am not aware of anything so I don’t know but I would say they should give you some kind of discount on the car seat if it was their mistake.
That is crazy that they did that. I would definitely call them, and write them a letter if they do not do anything about it. Keep your email.
Its Target’s fault it was missed marked, and they should honor the price to those who bought it. But complain: there is their contact info.
Edit: I know its not the same but I just got an email from Babycenter.com saying that Britaxs were up to $60 off this week only and free shipping.
You should file a complaint with Target for false advertising.
Did the email say why they cancelled the order? Unless they made a mistake in the price they advertised that would be a reason why they would cancel the order, but i would contact target and find out why if the email doesn’t state so.
You could file a complaint with the Better Business Bureau, not sure if anything will come of it but it’s worth a shot as long as you have proof that you ordered it at that low price. I think it would fall under false advertising, maybe but a lawyer would know for sure.
Hey, I’m in the UK but I saw the question you probably saw letting everybody know about it! I have no idea of the laws in America, but if it’s anything like Britain you *might* be able to ‘get them’ for false advertising, particularly if you already paid and they gave a refund (I presume they gave a refund if you paid?!). But I doubt they’d respond positively to a letter from an individual, so you need to ask yourself if it is worth you paying a solicitors fee for this, unless you happen to know anybody in that profession who’ll do you a ‘freebie’. I would guess, though, being such a big chain, that they’ll have checked with their lawyers/accountants that what they were doing did not breach any laws so unfortunately you might not have a leg to stand on. But you do occasionally hear of major companies cocking up – so fingers crossed! I’m guessing they withdrew it when they had such a huge influx of people buying it – well they should have thought about that before putting it out at such a ridiculously low price – it was obviously gonna sell like hotcakes!! I would never buy a car seat from Target. EVER!!!!
I had a car seat purchased for my daughter that was due in July 05(it was purchased for the shower in April) Obviously we had her in the infant carrier before we put her in the regular car seat. In November, we moved her and had the seat checked by the car seat safety people. The seat was cracked and unable to be used. I went back to Target and they told me it was after the 90 return policy and would not exchange it. My DD had been in it a week, cracked and unsafe. Target would not take it back. We finally called the CEO of Target and got the seat exchanged. Target ***** and I would never purchase a big product from them!!
Contact the CEO. Do not call the 800 number because you will talk to Joe in India who really can’t help you!
Go to Walmart or Babies r us and tell them that it was offered at Target for the lower price and see if they will match it. They will probably meet it!

If you’ve paid for it, it’s a legally binding contract. They can’t do that, it breaches the Trades Practices Act.
If you haven’t made it only order and the order specifies if there’s no more stock the order can be cancelled. Then they can argue.
Best to talk to Target, tell them if they dun fix it u’ll contract Fair Trading/ Consumer Affairs. They’ll be more helpful becos it’s a bad record to be record in Fair Trading. If still not resolved, then u can talk to Fair Trading.
Theres nothing you can do theres a disclaimer on the site that covers their *****.
I am so fuming mad at Target!!!!!!! I think we need to let Good Morning America or some other news story know about this! Target is wrong and they’re taking advantage because they’re such a huge company -and yes I already called and complained and they didn’t really care. I filled an official complaint, but they don’t care that a few people are mad – well lets all stick together and fight this! Where can I get the number of the CEO?
I also ordered 2 of these. Words cannot describe how upset I am with Target’s customer service re: this issue. I have wrote & emailed an complaint to them. I also emailed the CEO of target and recommend that everyone write an email to him as well. Hopefully something will get done and we will be granted the mispriced amount they listed.
i think people should stop whining… did consumers *really* think they could get a car seat that retailed for $250 for $50? some people just want something for nothing. many people were planning on profiting off this mistake. c’mon people, i think we all know it was a mistake.
i think this is somewhat of an acute reflection of the desperate nature this economy has put most of us in. we want to get ahead no matter what the cost to others and want something for nothing or super cheap (even if we know it’s too good to be true and most likely a mistake).
target got over 20,000 hits to the car seat to order! and that doesn’t include those that ordered multiple seats…that’s a generic loss of $4 million off of ONE error! how would you react if this was your company or small business?
i don’t think their loss would have been reasonable enough to eat. but, i do think they shouldn’t leave this ‘unresolved’ or not even attempt to remedy the solution in the eyes of the consumer. the fair thing to do would be to offer ’something’ instead of nothing to all who ordered the seat.
i’m sure target will either refund your money or ship you the product if you were charged. sorry, there nothing you can do because of target’s pricing disclaimer, which is standard for online retailers everywhere…
i’ve also heard people interested in a class action law suit for canceling the orders. what is the actual harm? what wrong did they do? the advertisement is not an “offer” under contract law, it is an invitation for you (the consumer) to make an offer. so in essence your order online was the offer to target which they had the ability to accept (creating a contract) by filling the order or decline by canceling the order. in this case acceptance of the contract is the performance (shipment).
